PCG Terms of Use for MP Database

This MP database is operated by the Professional Contractors Group ("PCG"). The objective of the database is to allow PCG members to report on details of contact with their Constituency MP (and other MP's as they may consider useful). A summary of the information will be made public. The following guidelines and terms apply to all members and to anyone reading information that is in the public domain. If you have any questions about the legal information that follows, please contact us directly. If you do not agree to these terms of use, you should exit the database.

  1. Member Conduct
    1. All members completing the MP database are expected to show courtesy to others and demonstrate respect, good taste and decorum. Failure to do so may result in the immediate termination of a member's right to use this area and may result in termination of access rights to the member's area. We have listed some examples below of unacceptable online behaviour that are considered to violate these terms of use:
      1. Use of unlawful, harmful, threatening, libellous, vulgar, abusive or defamatory statements, language or images.
      2. Actions which intentionally cause distress, embarrassment, unwanted attention or other discomfort to another.
      3. Sending chain letters or other junk mail.
      4. Sending unsolicited advertising or promotional material to others.
      5. Failure to respect the confidences of other members using the forum.
    2. This list is not exhaustive and we reserve the right to prohibit conduct that we believe may be harmful to any of our members. We reserve the right to monitor any postings to ensure that online standards are being maintained. The PCG reserves the right to disclose any information on records to satisfy any law, regulation or other governmental request and to maintain its online standards of conduct.
    3. The PCG also reserves the right to remove any information, messages or other material ("Content") that it deems in its sole discretion to be unacceptable, undesirable or in violation of these terms of use and to terminate the right of any member to use the MP database who misuses or fails to abide by these terms of use.
  2. Rules for submission to the MP database
    1. Members are solely responsible for any Content that is submitted, uploaded or posted on the MP database and are liable for any damage resulting from any infringement of proprietary rights or any other harm. By submitting Content to the MP database a member grants the PCG an unrestricted, royalty-free, perpetual, world-wide right and licence to use, reproduce, modify, publish, translate and distribute the Content and/or to incorporate it in other works.
    2. Members may not in any way commercially exploit any Content obtained from the PCG forum and must abide by the copyright and other proprietary restrictions and licences displayed in the particular Content. In the absence of any particular notices, a member may make copies of copyrighted, patented, trade marked or other proprietary materials displayed on the forum, provided that the materials are exclusively for personal use and that any notices contained in the material are maintained.
  3. Information and Opinions Expressed on the MP database
    1. We make no representation or warranties with respect to any information placed or opinions expressed on the MP database by members and do not endorse, oppose or edit any opinion expressed by a member or information or material provided by a third party. Members should exercise care in posting such information and in evaluating such information and opinions.
    2. We do not guarantee the accuracy or completeness of any information or content, nor its satisfactory quality or fitness for any particular purpose. In many instances, the information provided may represent opinion and judgement and/or may have been supplied by a member not in any way under agreement with the PCG. Under no circumstances will the PCG be liable for any loss or damage caused by a member's reliance on information obtained on the MP database.
  4. Disclaimer
    1. This MP database and its contents are provided without any representations or warranties of any kind, either express or implied. The PCG disclaims all representations and warranties, including by way of example but not limitation, as to fitness for a particular purpose, to the fullest extent permitted by applicable laws. In addition, the PCG does not represent or warrant that the information and/or facilities accessible via this MP database are accurate, complete or current, or that this forum will be free of defects, including, but not limited to viruses or other harmful elements. The user of this MP database assumes all costs arising as a result of the use of this database.
  5. Limitation of Liability
    1. To the fullest extent permitted by applicable laws, neither the PCG nor any of its respective directors, employees, affiliates or other representatives will be liable for loss or damages arising out of or in connection with the use of, or inability to use, the materials in and/or facilities or services offered through this MP database, including, but not limited to indirect or consequential loss or damages, loss of data, income, profit or opportunity, loss of or damage to property and claims of third parties, even if the PCG has been advised of the possibility of such loss or damages or such loss or damages were reasonably foreseeable. If this clause is unenforceable in whole or in part in any jurisdiction due to relevant laws, then in no event shall the PCG's total liability to you for all damages, losses and claims (whether in contract, tort (including but not limited to negligence) or otherwise) exceed the amount paid by you, if any, for accessing this MP database.
    2. Nothing in these terms shall operate or be construed to operate so as to exclude or restrict the liability of the PCG for death or personal injury caused by reason of the negligence of the PCG.
  6. Governing Law
    1. This MP database is operated by the PCG from the UK. We do not make any representation that materials in and/or facilities or services offered through this MP database are available for use in other locations or that they comply with any legal or regulatory requirements of such other locations. Members who use this MP database do so at their own risk and on their own initiative and are responsible for compliance with local laws, to the extent that any local laws are applicable. These terms shall be governed by and construed in accordance with English law. Any dispute under these terms shall be subject to the exclusive jurisdiction of the English courts and, by using this MP database, you hereby submit to the jurisdiction of such courts for such purposes and waive any and all objections to jurisdiction or venue in such courts.
