The last newsletter contained advice on completing your
P35 form, which must be submitted by May 19th. We know that
some people missed this during the Easter break:

The form does not ask "does your business provide personal
services to which the IR35 rules might apply?" Rather it is
saying "is any of your work caught by IR35?" This is a subtle,
but important difference to understand.
Contract Review Service
Since the last newsletter there has been some "lightening
of the workload" but the reviewers still have full order books
- if you intend to use the service before May 19th do not leave
it until the last minute.

New Service from PCG
In the next few days we expect to announce a completely
new insurance policy designed to support members who feel they
are genuine businesses, but who still feel uncertain and at
risk from IR35. Full details will be announced in the next few
days.
The Tax Liability Cover - TLC/35 insurance will provide an
indemnity providing cover for up to �50,000 aggregate in respect
of �
- The professional fees of one of the insurers consultants
to act on your behalf in defence of the investigation, and/or
- Compensation in respect of any additional tax, NIC, interest
and penalties relating to IR35 if an appeal against the dispute
is unsuccessful.
The professional fees cover will include representation by
the insurers at all appeals up to and including Commissioners
Hearings (General or Special). This is the first fully underwritten
service of this kind and PCG members will be offered the scheme
at a discount.
Explanation & Clarification
The last newsletter contained a message from the new PCG
chairman, without any attribution. Jane Akshar took over from
Gareth Williams in this role following the recent elections.
Jane previously served as PR Director.
Also, please note that the (post JR) newsletter number 17/01
was the work of several PCG members and should not have been
attributed to John Antell.
Other activities
PCG directors, CC, members and suppliers have all been
working hard post JR to reduce the uncertainty for all. We have
submitted to DTI for agency regulations, we are looking to take
the IR35 cause forward in a number of ways - politically, commercially
and legally and we are dealing with large numbers of clients,
agents and accountants who are looking for information and advice
in the aftermath of the court case. In addition, we are working
at ways to improve our messages into these groups at all levels
and expect to provide further advice for members soon. The Consultative
Council and Directors are meeting for a full day this weekend
and expect to make progress on many of these issues.
